Where can I find Oklahoma property dispute laws?
I have a dispute with my neighbor's neighbor regarding a property line. The barrier that separates us is encroaching on my property is about 30 feet. A field survey and legal description of my property with an aerial photograph. I checked with our courthouse and the county has no legal claim to the property. I am ready to pass the barrier, but I want to be sure I'm doing the right thing.
The staff at the courthouse county can not say whether or not your neighbor has the title to the area in question because they only have access to maps and descriptions that have been recorded with the county. They have no way of knowing whether or not your neighbor has inalienable rights, which could be based on an unwritten agreement or adverse possession.
If your property has been surveyed and the survey clearly identifies the fence as an intrusion, so you have a legitimate basis on which to file a court action for removing the fence.If you choose to remove the barrier of yourself without judicial support you, you run the risk of liability in case your neighbor revealed later that he had rights on the fence that were damaged by your action. Therefore, it may be unwise for you to act without a court order in your favor.
You may be able to convince your neighbor to remove the fence itself, informing him that you intend to take legal action. If he still refuses, ask him why he thinks he owns the property until closing.You should consult a lawyer, tell the lawyer what your neighbors is reason, and that counsel to investigate and determine whether or not your neighbor has a legitimate right. Thats the safest action.
Can cremated remains be buried on private property in Oklahoma?
I looked online for this answer, but found nothing cut and dried on it. Now I'm hoping someone can help me Cyberland.
My brother died in a car accident a few years ago, and it was his wish to be cremated. The deed was done, but he was sitting on a shelf in the bedroom of my father since that time. I want to be buried on our property in Oklahoma, with an appropriate marker, near a pond on the site. Is the private burial of the urn, with a marker, allowed Oklahoma? Do we have to get some kind of special permission to do that? Or can we just bury it with a marker, without having to go through all sorts of legal do it?
Any help on these questions would be appreciated.
Talk to the funeral home that handled your brothers cremation and ask them about your idea.they should have the answers or know how to get the answers.Being you own the property I do not see a problem, but check it out just to be sure.
